The Atameken National Chamber of Entrepreneurs of the Republic of Kazakhstan, as the sole founder of the Private Institution "Arbitration Centre of the Atameken National Chamber of Entrepreneurs of the Republic of Kazakhstan," considers it necessary to inform the public of recent personnel changes.
By order of the Chairman of the Management Board of the Atameken National Chamber of Entrepreneurs of the Republic of Kazakhstan, the powers of Askar Kaldybayev, Executive Director of the Arbitration Centre, have been terminated. Work is currently underway to appoint a new Executive Director, who will continue the development of the Arbitration Centre, ensure compliance with high standards in the organisation of its activities, and strengthen confidence in the institution of arbitration.
The personnel decision was made in connection with circumstances that arose during the consideration of one of the arbitration disputes. In the course of the arbitration proceedings, substantiated concerns were raised regarding compliance with ethical standards in the conduct of the process. Regardless of the nature and substance of the specific dispute, such circumstances require appropriate assessment and organisational measures, as the activities of the Arbitration Centre must be based on the principles of legality, independence, impartiality, professional ethics, and mutual respect among all participants in arbitration proceedings.
Askar Kaldybayev, Executive Director of the Arbitration Centre, guided by the principles of responsibility for the organisation of the institution's activities and the desire to preserve a high level of confidence in the institution of arbitration, decided to relinquish his powers. His application for release from office was granted.
The National Chamber of Entrepreneurs regards this case as grounds for further improvement of internal organisational procedures aimed at strengthening the corporate governance system, enhancing the quality of the Arbitration Centre's activities, and ensuring strict compliance with professional and ethical standards.
At the same time, we consider it necessary to emphasise that the Atameken National Chamber of Entrepreneurs of the Republic of Kazakhstan, as the founder of the Arbitration Centre, does not interfere in the consideration of specific arbitration cases, does not exert any influence on the opinion, inner conviction, or decisions of arbitrators, and is not entitled to predetermine the outcome of disputes under consideration. The independence of arbitrators, their impartiality, and their autonomy in decision-making are fundamental principles of arbitration proceedings and are strictly observed by the National Chamber of Entrepreneurs.
The Atameken NCE invariably adheres to the principles of the rule of law, the independence of arbitration, the equality of all participants in legal relations, and respect for the legitimate interests of business entities. We consistently support the development of independent alternative dispute resolution institutions and remain committed to building a state governed by the rule of law, in which law, professional ethics, and justice form the basis of all decision-making.
